Der internationale Schutz des geistigen Eigentums, d.h. der gewerbliche Rechtsschutz und Urheberrecht, hat eine weltweite rechtliche Grundlage durch das TRIPS-Abkommen (Agreement on Trade-Related Aspects of Intellectual Property Rights = Übereinkommen über handelsbezogene Aspekte der Rechte des geistigen Eigentums) erhalten, das mit dem Freihandelssystem GATT im Rahmen der neugegründeten Welthandelsorganisation (WTO =
World Trade Organisation) verbunden ist.
Das TRIPS-Abkommen von 1994 ist ein Meilenstein im internationalen Schutz dieser Rechte und das weitreichendste Übereinkommen nach der historischen Pariser (PVÜ) und Berner Konvention.
Unter der Regie der neugegründeten Welthandelsorganisation ist der internationale Schutz des geistigen Eigentums mit der Neuordnung der Handelspolitik verquickt.
Das TRIPS-Abkommen verpflichtet seine Mitglieder, die rechtlichen und gerichtlichen Bestimmungen zu forcieren. Dieser Band der ICC Studienserie unternimmt eine eingehende Analyse von all den Bereichen der Gesetzesregulierungen zum Urheberrecht und gewerblichen Rechtsschutz, die durch das TRIPS-Abkommen berührt werden. Das Werk ist ein unentbehrliches Mittel für Anwälte, Praktiker und Lernende auf diesem Gebiet.
Die Anhänge enthalten u.a. die englischen Texte des WTO- und TRIPS-Übereinkommens.
International protection of intellectual property, i. e., industrial property and copyright, has been placed on a new worldwide legal footing by virtue of TRIPS, the Agreement on Trade-Related Aspects of Intellectual Property Rights, which is linked to the GATT free trade system under the
auspices of the newly established World Trade Organization.
The Agreement on Trade-Related Aspects of Intellectual Property Rights of 1994 constitutes a milestone in the international protection of these rights and the most farreaching agreement to follow the venerable Paris and Berne Conventions. Under the aegis of the newly established World Trade Organization, international intellectual property protection has for the first time been linked to trade policy issues.
„From GATT to TRIPS“ constitutes a comprehensive survey over, and insight into, the new international Agreement and all of its components, from the general rules and special provisions on the various areas of industrial property protection and copyright to the obligations of the member states with regard to the enforcement of these rights and settlement of disputes. It also deals with the adoption of the Agreement’s provisions into national law, particularly within the framework of the European Community, which has itself become a signatory to the Agreement.
The TRIPs Agreement also commits its members to the enforcement of rights and dispute settlement.
