  „LONDON – Following the vote in the United Kingdom to leave the European Union, the UK government will take steps to stabilize the economy; it will have at least two years to negotiate the terms of that withdrawal with the other members. Until then, the UK remains an EU member state.
  
  If The United Kingdom leaves the European Union, significant changes to some aspects of IP protection and enforcement are expected to take effect in the UK.
  
  How will the UK’s exit from the EU affect intellectual property rights?
  Patent Protection
  • The UK’s participation in the existing European Patent system will not be affected, as the system is independent of the EU.
  
  • UK national patents are alike unaffected.
  • The current agreements on the Unitary Patent and the Unified Patent Court are based on the UK being a member of the system. Although the process of ratification of the treaty has been ongoing in some countries, it is uncertain at this stage if the Unitary Patent process will continue at all if the UK leaves the EU.
  Trademark Protection
  • UK national rights will remain active.
  • Following the withdrawal from the EU, transitional provisions would be put in place to divide European Union Trade Mark Registrations (EUTMRs) into separate EU registrations and national UK registrations.

     This Order is the first commencement order made under the Intellectual Property Act 2014 (“the Act”) and brings into force section 10(2) of the Act only to the extent necessary to appoint the appointed person. The appointed person will be able to hear and determine appeals under United Kingdom design law. Section 10(2) of the Act inserts new sections 27A and 27B into the Registered Designs Act 1949. Under new section 27A(1), the Lord Chancellor is responsible for making the appointment of the appointed person. New section 27B sets out the eligibility criteria, as well as the process for appointment and removal of an appointed person.

      These Regulations amend section 13 of the Intellectual Property Act 2014 (“the Act”), which inserts new sections 35ZA to 35ZD into the Registered Designs Act 1949 (“RDA”). Section 13 of the Act makes the intentional copying of a UK or EU registered design in the course of business a criminal offence (new section 35ZA of the RDA). New section 35ZC of the RDA relates to forfeiture powers in England, Wales and Northern Ireland; whilst new section 35ZD deals with forfeiture powers in Scotland. The amendments relating to new section 35ZD correct errors in the wording of the Act.
      The provision of criminal sanctions relates to the general obligation at Article 3(1) of the Intellectual Property Enforcement Directive 2004/48/EC for Member States to provide for the effective enforcement of intellectual property rights.

Section 60(5)(b) of the Patents Act 1977 provides an exemption from infringement in relation to acts done for experimental purposes relating to the subject-matter of the invention.

   These Regulations make provision for the implementation of Member State options in relation to exceptions relating to copyright and performers’ rights which are permitted by Directive 2001/29/EC(1) of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society. The provisions of the Directive relied on are Article 5(2)(c) in relation to publicly accessible libraries, educational establishments, museums and archives, Article 5(3)(a) in relation to illustration for teaching and scientific research and Article 5(3)(n) in relation to research and private study through dedicated terminals on the premises of educational and other establishments.

   These Regulations amend the Copyright, Designs and Patents Act 1988 (“the Act”). Article 5(3)(b) of Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society (OJ No L167, 22.6.2001, p.10) permits Member States to provide for an exception to the copyright and related rights provided under the Directive in the case of uses, for the benefit of people with a disability, which are directly related to the disability and of a non-commercial nature, to the extent required by the specific disability. These Regulations amend the way in which this exception is implemented in the UK.

Es löst die bisherigen Portale opsi.gov.uk (OPSI) und Statute Law Database (SLD) ab und vereint deren Funktionalitäten. Vorteilhaft an legislation.gov.uk ist vor allem, dass nun konsolidierte und nicht konsolidierte Gesetzesfassungen in einem Internetportal gebündelt vorliegen. OPSI und SLD werden nach dem vollständigen Datentransfer abgeschaltet.

  Bisher stellte OPSI nicht konsolidierte Originalversionen von Gesetzen und Statutory Instruments (die Rechtsverordnungen vergleichbar sind) online zur Verfügung. SLD bot konsolidierte Fassungen von Gesetzen an.

  Wie bereits bei SLD, sind auch im neuen legislation.gov.uk-Gesetzesportal die konsolidierten Gesetzesfassungen häufig nicht auf dem aktuellsten Stand. Allerdings wird auf die noch nicht aufgenommenen Änderungen noch besser hingewiesen.“

August 2001 in Kraft getreten. Sie lösen die bisherigen Regelungen „EC Competition Law (Articles 88 and 89) Enforcement Regulations 1996“ ab.

• Am 17. Februar 2000 sind die Ausführungsbestimmungen zum Markengesetz (Trade Marks Rules 2000) und die Trade Marks (Fees) Rules 2000 in Kraft getreten, die die Trade Marks Rules 1994 mit späteren Änderungen abgelöst haben. • Am 1. März 2000 wird ein neues Kartellgesetz (Competition Act 1998) in Kraft treten, das das britische Kartellrecht grundlegend reformiert und an das europäische Recht angleicht. Eine Übersicht ist in der Zeitschrift Recht der Internationalen Wirtschaft (RIW) – Betriebs-Berater International Heft 6/1999, S. 422 ff. veröffentlicht worden.

• Bei der Bundesstelle für Außenhandelsinformation, Postfach 10 05 22, 50445 Köln, ist eine Broschüre über „Rechtstips für Exporteure“ ((2. aktualisierte Auflage 1999) zum Preis von DEM 50,- unter der Bestell-Nr. 6919 zu beziehen.

• Großbritannien ist mit Wirkung vom 3. Januar 1999 als zehnter Staat dem revidierten Abkommen 1991 des Internationalen Übereinkommens zum Schutz von Pflanzenzüchtungen beigetreten. (UPOV-Pressemitteilung Nr. 34 vom 3. Dezember 1998)

• Mit den Patent (Fees) Rules 1998 (Statuory Instruments 1998 Nr. 1778) gelten ab dem 1. Oktober 1998 neue Gebührensätze. Die Gebühren für EP-Patente mit Wirkung in GB sind im ABl. EPA 1998, Heft 10, S. 506 f. aufgeführt.

03.01.1998

• Als Mitgliedsland des Protokolls 1989 zum MMA hat Großbritannien mit Wirkung ab 1. Februar 1998 folgende individuelle Gebühren festgelegt:
  
  • Bestimmungsgebühren für 1 Klasse: 525 CHF, für jede zusätzliche Klasse: 117 CHF
    
    
  • Erneuerungsgebühren: für 1 Klasse: 583 CHF, für jede zusätzliche Klasse: 467 CHF

• Als Mitgliedsland des Protokolls 1989 zum MMA hat Großbritannien mit Wirkung ab 1. Oktober 1997 folgende individuelle Gebühren festgelegt:
  
  • Bestimmungsgebühren für 1 Klasse: 558 CHF, für jede zusätzliche Klasse: 124 CHF
    
    
  • Erneuerungsgebühren: für 1 Klasse: 620 CHF, für jede zusätzliche Klasse: 496 CHF

• Das Markengesetz 1994 (Trade Marks Act 1994), in Kraft getreten am 31. Oktober 1994, geändert durch das Gesetz zum Schutz des olympischen Symbols etc. von 1995, in Kraft getreten am 21. September 1995, liegt auch in deutscher Übersetzung vor.

1994 – 1996:

• Die Verordnung Nr. 1447/1995 über nachgeahmte Waren und unerlaubt hergestellte Vervielfältigungsstücke oder Nachbildungen (Angleichungsverordnung), in Kraft getreten am 1. Juli 1995, liegt in deutscher Übersetzung vor.

• Der „Copyright, Designs and Patent Act 1988“ ist bezüglich seines Artikels 111 geändert worden durch die Verordnung Nr. 1445/1995 zum Urheberrecht (in Kraft getreten am 1. Juli 1995). Die deutsche Übersetzung liegt vor.

• Großbritannien hat der WIPO erklärt, daß sich ab 2. Oktober 1996 die Individualgebühren entsprechend Artikel 8(7) des Protokolls 1989 zum Madrider Markenabkommen (TT-LZ: 194A) von 227 CHF auf 96 CHF für jede zusätzliche Warenklasse reduzieren, wenn Großbritannien nach dem Protokoll bestimmt worden ist. Diese 96 CHF werden für jede Klasse von Waren und Dienstleistungen außer der ersten bezahlt. Eine Information der WIPO liegt in englischer und französischer Sprache vor.

• Für registrierte Muster sind neue Gebühren-Ausführungsbestimmungen („The Registered Designs (Fee) (No. 2) Rules 1995„) mit Wirkung vom 4. Dezember 1995 in Kraft getreten. Der Text liegt in englischer Sprache vor. /01/96/

• Die Britischen Patentausführungsbestimmungen (Patent Rules 1995) (in Kraft ab 4. September 1995) liegen TRANSPATENT in englischer Fassung in Papierdruck und als Textdatei vor. /11/95/

• Für das neue, am 31. Oktober 1994 in Kraft getretene Handelsmarken-Gesetz liegt eine weitere Übersicht in englischer Sprache vor. /10/95/

• Das Protokoll 1989 zum MADRIDER MARKENABKOMMEN ist von Großbritannien am 6. April 1995 ratifiziert worden.

• Das neue Britische Handelsmarkenrecht wurde vereinfacht. Es erfolgte eine Anlehnung an kontinentales Recht. Dadurch werden auch Kostenersparnisse für Unternehmen erwartet. /02/95/
